Welcome to R028's Terms of Service. By accessing and using our services, you agree to comply with these terms. Please read carefully before using our services.

These terms govern the use of services provided by R028, including Discord bots, software development, and web services.

If you do not agree with any of these terms, you should not use our services.

R028 reserves the right to modify these terms at any time. Significant changes will be communicated through our official channels.

Continued use of our services after changes to the terms constitutes acceptance of the new terms.

It is your responsibility to periodically review these terms to be aware of any changes.

By making a payment, you confirm that you have read, understood, and fully accept these terms of service.

Tacit acceptance of these terms occurs when using the services after purchase, without the need for additional confirmation.

These terms are an integral and inseparable part of the purchase and service provision contract.

About the Services

R028 offers software development services, including custom Discord bots, web development, and other technological solutions.

Our services are provided 'as is' and may be subject to interruptions, maintenance, or updates without prior notice.

Minimum Age

You must be at least 13 years old to use our services. If you are under 18, make sure you have the supervision of a legal guardian.

What to Expect

Our services are developed with the goal of providing quality and efficiency. However, we do not guarantee availability, accuracy, or suitability for any specific purpose.

User Content

You are responsible for all content you submit, post, or transmit through our services. You guarantee that you have all necessary rights to such content.

Software Licensing

The software provided by R028 is licensed, not sold. You receive a limited, non-exclusive, and non-transferable license to use the software as specified.

You may not modify, distribute, sublicense, or create derivative works of the software without express written authorization.

All trademarks, copyrights, and other intellectual property rights remain the property of R028.

The license granted is personal and non-transferable, exclusively linked to the account that made the purchase.

Reverse engineering, decompilation, disassembly, or any attempt to discover the source code of services provided by R028 is strictly prohibited.

Services are licensed for personal and non-commercial use, except through express written agreement authorizing commercial use.

R028 reserves the right to immediately revoke access to services if it detects any misuse, violation of terms, or attempt to manipulate the services.

There is no right to perpetual access to services. Access is guaranteed only for the contracted period (monthly, annual, or one-time use), as specified at the time of purchase.

All content, including but not limited to code, designs, logos, texts, and graphic materials, is the property of R028 and protected by copyright laws and other intellectual property laws.

Usage Restrictions

When using our services, you agree not to:

  • Violate any applicable law or regulation;
  • Interfere or disrupt the operation of our services;
  • Attempt to gain unauthorized access to our systems or data;
  • Use our services for illegal or unauthorized activities.

Anti-Fraud Policy

R028 implements strict policies to prevent and detect fraudulent activities on our services.

Creating multiple accounts to circumvent limitations, obtain undue discounts, or violate any terms of service is strictly prohibited.

Unauthorized resale, redistribution, or sharing of purchased products and services is prohibited, except through express written agreement with R028.

Account sharing is only permitted when explicitly authorized in the specific terms of the purchased product. Otherwise, each account is personal and non-transferable.

R028 reserves the right to monitor, detect, and automatically block any suspicious behavior or pattern that indicates possible fraud or misuse.

In case of suspected fraud, R028 may request official identification documents, proof of residence, or other information for identity verification.

Detection of fraud will result in immediate blocking of all associated accounts, cancellation of services without refund, and possible legal action.

Users whose accounts have been blocked for fraud are prohibited from creating new accounts under penalty of legal action.

Termination

R028 reserves the right to terminate or suspend your access to services at any time, with or without cause or notice.

We may terminate your access immediately if you:

  • Violate these terms of service;
  • Use our services fraudulently or illegally;
  • Cause damage to our systems or other users;
  • Fail to pay fees or amounts due;
  • Request termination of your account.

Upon termination, your right to use the services will cease immediately.

In case of proven fraud, termination will be immediate and there will be no right to refund any amount paid.

Termination for violation of terms after prior notice does not generate the right to a refund, even if contracted period remains.

R028 maintains the right to retain account data for a minimum period of 5 years after termination, in accordance with applicable legal and fiscal requirements.

After account termination for violation of terms or fraud, it is expressly prohibited to create a new account. Violation of this prohibition will result in permanent blocking and possible legal action.

In case of termination at the user's request, data will be retained for the legally required period and then deleted according to privacy policy.

Indemnification

You agree to indemnify and hold R028 harmless from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from the use of our services or violation of these terms.

Service Availability

We make reasonable efforts to keep our services available, but we do not guarantee that services will always be available, uninterrupted, or error-free.

We may perform scheduled or unscheduled maintenance that may result in temporary unavailability of services.

Service Modifications and Discontinuation

R028 reserves the right to modify, update, alter, or discontinue any service at its sole discretion.

In case of substantial modifications or service discontinuation, R028 will provide prior notice of at least 30 days through our official communication channels.

After a reasonable period of use (minimum 6 months for annual plans or 1 full month for monthly plans), R028 has no obligation to provide refunds in case of service discontinuation.

Critical security modifications or bug fixes may be implemented without prior notice to protect the integrity of services and user data.

If substantial modifications make services significantly different from what was originally contracted, the user may request cancellation and proportional refund within 7 days after notification of the modification.

Updates, improvements, and new features may be added or removed without prior notice, provided they do not substantially alter the nature of the contracted service.

R028 is not responsible for changes in third-party services (such as Discord, external APIs) that may affect the functionality of our services.

Limitation of Liability

To the maximum extent permitted by law, R028 will not be liable for direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.

Our total liability will not exceed the amount paid by you for services in the 12 months prior to the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

Digital products and services are provided 'as is' and 'as available', without warranties of continuity, permanent availability, or future compatibility.

R028 is not responsible for interruptions or unavailability caused by changes in third-party services (Discord, APIs, payment gateways), technical failures, scheduled maintenance, updates, or events beyond our control.

There is no guarantee that services will be free of errors, bugs, or interruptions, or that defects will be corrected within a specific timeframe.

R028 is not responsible for loss, corruption, or unavailability of user data, including but not limited to settings, preferences, or information stored through our services.

There are no implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except those expressly provided in these terms.

Dispute Resolution

Any dispute related to these terms will be resolved through binding arbitration in accordance with Brazilian laws, in the city where R028 is established.

Before initiating any legal or arbitral proceeding, the user must attempt to resolve the dispute directly through R028's official support channel, providing complete details of the issue.

R028 commits to respond to all complaints within a maximum period of 30 calendar days from receipt of the formal resolution request.

If the dispute cannot be resolved through direct support, it will be submitted to arbitration as provided in Brazilian laws. Arbitration costs will be shared equally between the parties, except if the decision is favorable to the user, in which case R028 will bear all costs.

The competent forum to resolve any controversy or conflict related to these terms is the forum of the user's place of residence, except for imperative legal provisions to the contrary.

Any dispute related to transactions or services must be formalized within 90 calendar days from the transaction date or the occurrence of the triggering event. After this period, the dispute will not be accepted.

In case of disputes related to chargebacks or refunds, the user must first contact R028 through official channels before requesting a refund from the card issuer or financial institution.

Important Provisions

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These terms constitute the complete agreement between you and R028 regarding the services.

R028 may transfer its rights and obligations under these terms to third parties without your consent.

These terms are governed by the laws of Brazil.

You may not transfer your rights or obligations under these terms without prior written consent from R028.

R028's failure to exercise any right or provision of these terms does not constitute a waiver of such right or provision.

Any waiver must be made in writing and signed by an authorized representative of R028.

Delivery Policy

The delivery of R028's digital services is not performed automatically. After payment confirmation, you must open a ticket to provide the necessary information for service activation.

When making a purchase, you must open a ticket on our official Discord server, providing the necessary information for activation of the purchased service.

After all information has been provided correctly through the ticket, the service will be activated within 1 business day.

For monthly or annual products, the access period begins after service activation through the ticket process.

One-time use products have validity as specified at the time of purchase and access is granted after service activation.

R028 is not responsible for delivery delays caused by missing necessary information or delays in opening/updating the ticket.

To expedite the activation process, make sure to provide all requested information completely and correctly in the ticket.

If you have questions about what information is needed or about the status of your order, contact us through the ticket opened on our Discord server.

Refund Policy

Refund requests must be made within 7 calendar days from the date of service activation through a ticket on the official Discord server.

One-time use products that have already been activated or used are not eligible for refund, regardless of the time elapsed.

For monthly or annual products, the refund will be proportional to the unused time, calculated from the request date until the end of the contracted period.

In case of cancellation requested by the customer, an administrative fee of 10% will be applied on the refund amount to cover processing and operational costs.

There is no right to refund when termination occurs due to violation of these terms of service, fraudulent use, or any conduct that violates R028's policies.

Refunds are granted only when the service has not been activated or used. Once the service has been activated and used, even partially, the refund will not be authorized.

The refund will be processed in the same form of payment used in the original purchase, within 15 to 30 business days after approval of the request.

Discounts, promotions, or bonuses received in the original purchase will be deducted proportionally from the amount to be refunded.

Payment and Fraud Policy

For transactions above $100 (one hundred dollars) or equivalent, R028 may require mandatory identity verification through official documents before processing payment or activating the service.

Fraudulent chargebacks or refunds will result in permanent account blocking, immediate cancellation of all services, and possible legal action for moral and material damages.

The use of credit cards, debit cards, or other payment methods from third parties without express authorization from the cardholder is strictly prohibited. Violation of this rule constitutes fraud and will be treated as such.

Fraud attempts, including but not limited to use of unauthorized cards, fraudulent chargebacks, or creation of multiple accounts, will result in permanent blocking, cancellation without refund, and referral to competent authorities.

The user is responsible for immediately notifying R028 (within 7 days) of any unauthorized payment or suspicious transaction on their account. After this period, it is presumed that the user authorized the transaction.

R028 uses automated fraud detection systems and monitors patterns of suspicious behavior. Accounts showing suspicious behavior may have transactions blocked or be suspended for verification.

In case of detection of multiple accounts associated with the same user or payment methods, all accounts will be blocked and services cancelled without refund.

R028 reserves the right to refuse to process any payment or transaction it considers suspicious or potentially fraudulent, without the need for prior justification.

These Terms of Service are in compliance with Brazilian legislation, including the Consumer Defense Code (Law No. 8,078/1990), the General Data Protection Law - LGPD (Law No. 13,709/2018), and the Internet Civil Framework (Law No. 12,965/2014).

R028 is committed to protecting users' personal data, in accordance with LGPD, ensuring that all information collected is used exclusively for the purposes described in these terms and in our Privacy Policy.

The services offered by R028 are provided in compliance with consumer protection standards established by the Consumer Defense Code, guaranteeing basic consumer rights, including protection of life, health and safety, education and information about adequate consumption of products.

In case of conflicts or disagreements, the user has the right to appeal to consumer protection agencies, such as PROCON, or to Special Civil Courts, as established by current legislation.

R028 is committed to maintaining transparency in commercial relations, providing clear information about prices, payment conditions, delivery times, and cancellation and refund policies.

All contracts and agreements established between R028 and users are governed by Brazilian legislation, and any controversy will be resolved in the court of the user's place of residence, except for legal provisions to the contrary.

R028 respects intellectual property rights, not allowing the violation of copyrights, registered trademarks, or third-party patents through our services.

Users have the right to cancel service contracts, under the terms of the Consumer Defense Code, with the right to proportional refund when applicable, respecting legal deadlines.

R028 maintains adequate records of all transactions and contracts, ensuring traceability and compliance with applicable tax and fiscal obligations.

Any modification to these terms will be communicated to users at least 30 days in advance, allowing those who do not agree with the changes to terminate their contractual relationship without penalties.

Data Protection and Privacy

R028 collects only the personal data strictly necessary for provision of contracted services and compliance with legal and fiscal obligations.

All personal data is stored and processed in accordance with the General Data Protection Law (LGPD - Law No. 13,709/2018), ensuring security and confidentiality.

Collected data is shared with third parties only when strictly necessary for service provision (payment gateways, hosting providers) or when required by law.

Users have the right to request access, correction, deletion, or portability of their personal data, as provided in LGPD, through formal request in official channels.

The right to be forgotten (data deletion) will be respected after the legal mandatory retention period (5 years for fiscal data, as per applicable legislation).

R028 implements technical and organizational security measures to protect data against unauthorized access, alteration, disclosure, or destruction, but cannot guarantee absolute security.

In case of data breach that may result in risk to users' rights and freedoms, R028 will notify the National Data Protection Authority (ANPD) and affected users as required by LGPD.

Browsing data, cookies, and usage information may be collected for service improvement and user experience, always in compliance with LGPD and with possibility of management by the user.
